TAX CERTIORARI

Lite & Russell is one of the few select law firms that handle Commercial Tax Certiorari. The area of law commonly referred to as “Tax Cert” involves the reduction of real estate property taxes. Actually, the word “certiorari” is based in Latin, meaning review. So simply stated, our firm represents commercial property owners towards the reduction of their property taxes.

There are a few unique and interesting aspects and points involving a tax certiorari matter. First, our fee is contingent upon a successful reduction of the real property assessment. If there is no savings, there is no fee. Our fee is generally one-third (1/3) of the total tax savings, which is usually based upon the actual tax savings refund that is received from the County Treasurer. Secondly, there is no penalty or hardship incurred by seeking a refund. Many clients ask or ponder that the assessor might actually raise their taxes or retaliate if they seek such relief. By law, the assessment review board can only reduce your assessment; in other words, there is absolutely no harm in trying. Thirdly, Lite & Russell is staffed and equipped to handle you entire matter. All that would be needed is some basic information along with a retainer and authorization to represent your interests. Finally, we can only seek a prospective reduction; unfortunately, there is no right or procedure to seek retroactive relief for prior tax years.
